By using this platform, you agree to the terms outlined below.

1. General

• Jesta Time operates a platform for creating digital group greeting pages, collecting contributions from participants, and delivering a memorable gifting experience.
• The platform is intended for users aged 18 and older.
• We reserve the right to update these terms at any time at our sole discretion.

2. Content Responsibility

Each greeting page has a designated organizer who is solely responsible for:

• All content uploaded to the page,
• Managing participants,
• Removing inappropriate profiles or content.

Jesta Time is not liable for any offensive or inappropriate content submitted by participants. Full responsibility lies with the page organizer.

We reserve the right to remove content that violates applicable law at our discretion.

3. Technical Infrastructure & Hosting

The platform relies on third-party infrastructure services, including:

• Storage and data providers,
• Database management systems,
• Payment processors,
• Email delivery services.

Jesta Time is not liable for outages, delays, data loss, or unavailability caused by third-party infrastructure disruptions.

4. Service Plans & Pricing

Creating a page on Jesta Time is completely free. The entire process — from creating the page to collecting greetings from participants — costs nothing.

• Up to 25 participants can join for free.
• All greetings are viewable for free for 72 hours from the moment the recipient opens the page.

Optional Upgrade — Add More Participants

If your page reaches the 25-participant free limit, you can purchase additional participant slots. These upgrades can be purchased by the page organizer or by any participant directly from the participation page.

All participant slot purchases are one-time payments with no subscription.

Optional Upgrade — Save Forever

If you'd like to keep all the greetings accessible beyond 72 hours, you can purchase a one-time "Save Forever" upgrade.

• During the 72-hour window: $34.90 (one-time payment).
• After the 72-hour window has passed: $49.90 (one-time payment).

5. Payments & Refunds

All payments are processed in USD through secure, third-party payment providers. By completing a purchase, you authorize us to charge the applicable amount to your selected payment method.

Refund Policy: All sales are generally final. Refunds will be issued in the following circumstances:

• A verified technical failure on our part prevents access to a paid feature within 14 days of purchase.
• A duplicate charge or billing error is confirmed.
• Required by applicable consumer protection law.

To request a refund, email support@jestatime.com within 14 days of the issue.

6. Data Retention & Content Deletion

Pages without Save Forever:

• Greetings are accessible for free for 72 hours after the recipient first opens the page.
• Pages without a "Save Forever" upgrade may be permanently deleted after two years.
• This deletion is permanent and irreversible.

7. Save Forever — Terms & Conditions

Users who purchase the "Save Forever" upgrade are entitled to permanent viewing access to their greeting page.

• Pages with this upgrade are protected from automatic deletion and stored permanently.
• Warranty period: up to 5 years from the date the greeting page was first opened.

8. Intellectual Property

All designs, branding, and content on this platform are the property of Jesta Time. Unauthorized use of any materials is prohibited without prior written consent.

9. User Content License

By submitting content to the platform, you grant Jesta Time a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display such content solely in connection with operating the Service.

10. Use of Pages for Demo & Marketing

• Jesta Time may display publicly accessible greeting pages for demo and marketing purposes.
• Content marked as private will never be used for marketing.
• Page organizers may request their page not be used for marketing purposes.

11. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JESTA TIME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL JESTA TIME'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID IN THE PRIOR 12 MONTHS, OR (B) $100 USD.

12. Indemnification

You agree to defend and hold harmless Jesta Time from claims arising out of your content, your violation of these Terms, or your misuse of the Service.

13. DMCA Copyright Policy

Jesta Time complies with the DMCA. To submit a takedown notice, email support@jestatime.com (Subject: "DMCA Takedown Notice") with a description of the infringing material and your contact information.

14. Dispute Resolution & Arbitration

Any dispute arising out of these Terms will be resolved by binding individual arbitration under AAA rules. Class action waiver applies. Governing law: State of Delaware.

You may opt out of arbitration by emailing support@jestatime.com within 30 days of first using the Service.

15. Termination

Jesta Time may suspend or terminate your access at any time for violations of these Terms or unlawful activity.

16. Governing Law

These terms are governed by the laws of the State of Israel. Jurisdiction lies with the courts in the Tel Aviv district.

17. WhatsApp Bot — Terms of Use

Jesta Time operates a WhatsApp-based conversational bot powered directly by Meta Platforms, Inc. (WhatsApp Business API). By initiating a conversation with the bot (for example, by clicking a pre-filled WhatsApp link from jestatime.com), you agree to the following:

• Consent to Messaging: By starting a conversation, you consent to receiving WhatsApp messages from Jesta Time strictly related to the service you initiated (e.g., verification codes, edit links, page confirmation). No unsolicited commercial messages will be sent.
• Opt-Out: You may end the conversation at any time by replying STOP. Your active session will be closed immediately.
• Content Responsibility: You are solely responsible for any text, images, or videos you submit through the bot. Content must not be offensive, unlawful, or infringe on the rights of others. Jesta Time reserves the right to remove any content that violates these terms.
• No Age-Gated Content: The WhatsApp bot does not facilitate or transmit age-gated, adult, or otherwise restricted content. Users must be 18 years of age or older to use this feature.
• Third-Party Services: The bot is powered directly by Meta Platforms, Inc. (WhatsApp Business API). By using the bot, you acknowledge that your communications are also subject to Meta's/WhatsApp's Terms of Service.
• Availability: Jesta Time is not liable for delays, errors, or unavailability of the WhatsApp bot resulting from disruptions by Meta/WhatsApp or other third-party infrastructure providers.
